The Information Technology Association of Canada d/b/a TECHNATION Canada (“TECHNATION Canada”, “we”, “us”) owns and operates the website located at https://lms.technationcanada.ca (the “Website”) is committed to protecting your privacy when you use our Website. In this policy we explain how and why we collect your information; what we do with it and what controls you have over our use of it. From time to time, we add or change functions, features or products to or at our web site, or use add or change our Website. This, and our commitment to protecting your Personal Information, may result in periodic changes to this Privacy Policy. As a result, please remember to refer back to this Privacy Policy regularly to review any amendments. What Data do we Collect and How do we Use it?

TECHNATION Canada collects certain information from you when you use our Website. We process Personal Information only to the extent necessary for the purposes described in this Privacy Policy. We set out below the type of Personal Information we collect and how we use such Personal Information. Except as set forth in this Privacy Policy, your Personal Information will not be used for any purpose without your consent. You may withdraw your consent to our processing of your Personal Information at any time, however withdrawing consent may result in your inability to continue to use the Website. Notwithstanding the foregoing, TECHNATION Canada may disclose Personal Information if required to do so by law or if it believes that such action is necessary to protect and defend the rights, property or safety of TECHNATION Canada staff and its Website and visitors to the Website.

The type of Personal Information we collect from you when you use the Website includes: your name; email; gender; information related to your work or school as applicable; username; password; and basic site information, including but not limited to your IP address.

We also collect Personal Information from you when you:

• Correspond with us by e-mail or otherwise. We ask you to disclose only as much information as is necessary to submit a question/suggestion/comment in relation to our Website.
• Supply us with goods or services. Suppliers may provide us with information which may include a contact name; email address; business address; and telephone number.

We may automatically collect non-personal information associated with you, such as the type of internet browsers you use. You cannot be identified from this information and it is only used to assist us in providing an effective service on our Website. Our Website contains links to the sites of third parties. When you visit these sites, we suggest that you read their privacy policies. TECHNATION Canada is not responsible for the privacy policies or the content of such sites.

A Note About Children. The Website is intended to be used by Canadian students attending university. You may not use the Website if you are less than 16 years of age or are younger than the minimum legal age in your country to use our Website. We do not intentionally gather Personal Information from visitors who are under the age of 16. If we learn that Personal Information submitted is the Personal Information of a child under the age of 16, we will attempt to delete the Personal Information as soon as possible. If you believe that we may have Personal Information from a child under the age of 16, please contact TECHNATION Canada (privacyofficer@technationcanada.ca).

Access, Correction and Accuracy

You have the right to access the Personal Information we hold about you. Upon receipt of your written request, we will provide you with a copy of your Personal Information, although in certain limited circumstances, and as permitted under law, we may not be able to make all relevant Personal Information available to you, such as where that Personal Information also pertains to another individual. In such circumstances we will provide reasons for the denial to you upon request. We will endeavor to deal with all requests for access to and modifications of Personal Information in a timely manner.

We will make every reasonable effort to keep your Personal Information accurate and up to date, and we will provide you with mechanisms to update, correct, delete or add to your Personal Information as appropriate. As appropriate, this amended Personal Information will be transmitted to those parties to which we are permitted to disclose your Personal Information.

Retention

We will keep your Personal Information for as long as it remains necessary for the identified purpose or as required by law, which may extend beyond the termination of our relationship with you.   We may retain certain data as necessary to prevent fraud or future abuse, or for legitimate business purposes, such as analysis of aggregated, non-personally identifiable data, account recovery, or if required by law. All retained Personal Information will remain subject to the terms of this Privacy Policy.

Use of Cookies

Cookies are pieces of information that a website transfers to your hard drive to store and sometimes track information about you. Most web browsers automatically accept cookies, but if you prefer, you can change your browser to prevent that. However, you may not be able to take full advantage of our Website if you do so. Cookies are specific to the server that created them and cannot be accessed by other servers, which means they cannot be used to track your movements around the web. Although they do identify a user’s computer, cookies do not personally identify user accounts or passwords.

We use cookies for the following reasons:

• To estimate our audience size and patterns;
• To ensure that you are not asked to register twice (if applicable);
• To control how often visitors see similar ads (if applicable); and
• To improve and update our Website.

TECHNATION Canada will not share, sell or rent your Personal Information to third parties. Personal Information provided by you to such third parties is subject to their own privacy policies.

Users Outside of Canada

By visiting the Website you acknowledge and agree that your Personal Information may be processed for the purposes identified in this Privacy Policy in a country where laws regarding the processing of Personal Information may be less stringent than the laws in your country. By using the Website and providing us with your Personal Information you consent to such transfer.

Residents of the European Economic Area (“EEA”) and the UK

TECHNATION Canada does not specifically market the Website to residents of the EEA or UK. If the European Union’s General Data Protection Regulation (“GDPR”) is deemed to apply to TECHNATION Canada’s practices, the following terms shall apply:

Transfers of any personal data (as that term is defined under the GDPR) of residents of the EEA are made in accordance with permitted legal measures under applicable laws. Whenever we transfer personal data out of the EEA, we ensure a similar degree of protection by at least one of the following safeguards:

• The country to which the personal data is being sent has been deemed to provide an adequate level of protection for personal data by the European Commission.
• Where we use certain service providers, we may use specific contracts approved by the European Commission which give personal data the same protection it has in the EEA.
• Where we use providers based in the U.S., we may transfer personal data to them which requires them to provide similar protection to personal data shared between the EEA and the U.S.
• The legal grounds under which we process personal data of EEA residents are:
  • with consent;
  • to perform the services you have requested from us or, upon your request, to take the steps necessary to provide you with such services; or
  • in the furtherance of our legitimate interests in maintaining business relationships and communicating with you as a business contact, about our activities and Website.

Further, individuals located in the EEA have certain rights under European law (including under the GDPR) with respect to personal data, including the right to request access to, obtain, correct, amend, delete, or limit the use of your personal data. Individuals who are located in the EEA and who wish to exercise these rights, should contact us using the contact information noted below. If the inquiry relates to personal data collected by a third party, such as one of our clients, you should contact such third party.

Individuals also have the right to make complaints to regulatory authorities in respect of our privacy practices.

We may need to request specific information from you to help us confirm your identity and ensure your right to access your Personal Data (or to exercise any of your other rights). This is a security measure to ensure that Personal Data is not disclosed to any person who has no right to receive it.

You will not have to pay a fee to access your Personal Data (or to exercise any of the other rights). However, we may charge a reasonable fee if your request is clearly unfounded, repetitive, or excessive. Alternatively, we may refuse to comply with your request in these circumstances.

California Residents

This section provides additional details about the Personal Information we collect about California consumers and the rights afforded to them under the California Consumer Privacy Act (the “CCPA”).

Subject to certain limitations, the CCPA provides California consumers the right to request to know more details about the categories or specific pieces of Personal Information we collect (including how we use and disclose this Personal Information), to delete their Personal Information, to opt out of any “sales” of Personal Information that may be occurring, and to not be discriminated against for exercising these rights.

California consumers may make a request pursuant to their rights under the CCPA by contacting us at privacyofficer@technationcanada.ca. We will verify your request using the information associated with your account, if available, including email address. Government identification may be required. Consumers can also designate an authorized agent to exercise these rights on their behalf.  

Security

TECHNATION Canada places a great importance on the security of all information associated with our customers. We have security measures in place to attempt to protect against the loss, misuse and alteration of Website user data under our control. Our security and privacy policies are periodically reviewed and enhanced as necessary and only authorised personnel have access to user information. While we cannot ensure or guarantee that loss, misuse or alteration of data will not occur, we use our best efforts to prevent this.

Sub-processors

To support us in maintaining the Website, we engage third-party service providers as sub-processors.

This section identifies our sub-processors, describes where they are located, lists the services they provide to us and identifies the type of Personal Information processed.

Our business needs may change from time to time and we will periodically update this list to provide notice of additions and removals to our list of sub-processors.
